Regulatory Crime

Regulatory Crime

Recent years have seen a significant increase in the incidence and profile of regulatory crime issues. Health and safety is a key area. The entry into force of the Corporate Manslaughter and Corporate Homicide Act 2007 in April 2008 has far reaching implications for corporate and other entities and their senior management. Proceeds of crime is another area with an increasing impact across a wide spectrum of commercial and professional activities. Regulatory crime issues arise also in other contexts, including environmental law areas such as waste and contaminated land, financial services, competition law, consumer protection and trading standards.

Regulatory crime is at the interface of civil and criminal law. A number of members of Chambers are experienced in both civil litigation and criminal proceedings, and are well placed to advise on regulatory crime issues, either on a pro-active advisory basis or in response to proceedings which have been raised.
