Wills and Succession

Wills and Succession

The devolution of a person's estate, following their death, can be complicated by various factors. Sometimes complications may arise due to changes in circumstances, for example: domicile; pre-death gifting; health and capacity; or family disagreements. In other cases, there may be difficulties in determining the validity and meaning of testamentary writings or in the administration of an executry estate.

A number of our members practice in the field of Wills and Succession. They balance expertise with an appreciation of the sensitivities of this specialist area and commercial acumen. A number of our members are members of STEP.

Areas of expertise include:

  • The scope of trustees' powers and duties
  • Rectification of wills
  • Drafting trust documents
  • Testamentary capacity and third party influence
  • Administration of estates, including cross-border issues
  • Legal rights claims
  • Conflicts of law issues
  • Charitable trusts
  • Professional negligence
