Ralph Smith QC successfully appeared for The Highland Council in upholding a decision of the planning authority, in the recent case of Tesco Stores Limited v The Highland Council and Asda Stores Limited. The decision under challenge was to grant planning permission to Asda for a large supermarket in Tain. The petitioners had argued the Council had failed to apply the sequential test; and that councillors had conducted themselves in a way giving rise to reasonable apprehension of bias. Roy Martin QC, Ms Munro and Malcolm Thompson QC also appeared.
