Ralph Smith QC successfully appeared for The Highland Council as planning authority, in the case of G Hamilton (Tullochgribbon Mains) Ltd v The Highland Council and Ennstone Thistle. The case involved the listing of a quarry in the context of the review procedure for mineral permissions (“ROMP” applications). It was successfully argued that the planning authority had not extinguished the underlying planning permission by the way in which a particular site was listed. James MacNeill QC, Ms Ross and Roy Martin QC also appeared. The judgement is available here.
