Arbitration

The Arbitration (Scotland) Act 2010 brings Scottish domestic and international arbitration up to date and Scotland now benefits from having all of Scottish domestic and international arbitration law in one accessible and user friendly piece of legislation.

With the coming into force of the new Act, parties, both in Scotland and abroad, will have the choice of resolving their differences by arbitration, a dispute resolution process which is normally quicker and more cost effective than litigation. An additional benefit is that arbitrating at an international level in Scotland will be considerable cheaper than the traditional arbitration centres of London, Paris, Geneva and New York.

Parties will be able to choose the arbitrator(s), the procedure, the language, the seat (jurisdictional location), the venue and they will be able to set the timeframe. Lastly and most importantly of all they will benefit from high quality and low cost Scottish legal services.

Terra Firma Chambers is very well placed to welcome the new Act by offering parties to a dispute the advantages of:

  • More specialist arbitration Advocates than any other Chambers or Stable at the Scottish Bar. A number of our Advocates have been accredited by the Chartered Institute of Arbitrators in London.
  • Many of our Advocates have hands-on practical experience of a wide variety of ad hoc and institutional domestic and international commercial arbitrations.
  • Some of our Advocates are also experienced in investment arbitration.
  • More arbitration academics than any other Chambers or Stable at the Scottish Bar.
  • More English law dual qualified Barrister members than any other Chambers or Stable (the New Scottish Act is similar in many respects to the English Arbitration Act 1996)
  • Quality arbitrators
  • Cost effective legal services - at all levels, from advising on drafting clauses and implementing agreements, drafting pleadings and submissions to supporting the tribunal, and appearing as counsel.
  • Urgent advice and on call service where necessary in support of the tribunal/parties whether by seeking interdicts ad interim (interim relief) or intervening to sist (stay) court actions raised in contravention of an arbitration agreement.
  • Internationally enforceable Awards under the New York Convention in the Scottish Courts and in other signatory States.

Scotland benefits from having a high quality legal system complimented by high quality lawyers at a cost effective price, which result in Scotland being one of the world's best forums of choice in which to arbitrate.

Our Chambers also provides Advocates with other dispute resolution experience, namely Mediation services both as Mediator and Counsel. They hold accreditations from CEDR, CORE Mediation and others.
