Bankruptcy and Insolvency

Anyone working in the areas of construction, development and insolvency needs to be aware of the risks and opportunities afforded to creditors and debtors by administration, receivership, insolvency, bankruptcy, and the effect on diligence.

A number of our members have developed a particular interest in insolvency, and frequently provide opinions on matters such as vesting and the ranking of claims, as well as work in obtaining or seeking recall of sequestration, the appointment of provisional or interim liquidators, the appointment and powers of administrators, and obtaining discharges and approval of accounts and fees in both the Sheriff Court and Court of Session.
