Unjustified Enrichment

Principles of unjustified enrichment infuse many areas, including but certainly not limited to such matters as: ultra vires local government involvement on the SWAP markets; complex land holdings and commercial lease arrangements; estranged co-habitants who have improved their former partner's property; and even "disappointed beneficiaries" who have laboured for another's benefit without the promised gain.

At Terra Firma Chambers we have members who will advise and, where appropriate, represent in Court those claiming that there is an enrichment which justice demands be reversed. Equally, those who wish to hold what they have may wish to turn to the members of Terra Firma Chambers for legal representation and advice.

Unjustified enrichment covers a similar cluster of issues to restitution in England but the approaches in the two legal systems are not always identical. Direct Access rules for instructing Scottish Counsel may be particularly useful to English solicitors (and others with direct access rights) wishing to obtain advice for their clients in cases where there is a Scottish connection.
